CLINICAL NEGLIGENCE


Keith Carter & Associates have been providing expert evidence in clinical negligence cases since 1984.

We typically undertake 100 such cases each year, acting for claimants, defendants and by joint instruction. As one of the longest established employment consultancies in the UK, we have compiled a total of over 13,000 expert employment reports.

During this time we have built up an excellent database of employment evidence which forms the essential foundation for our work.

We are Law Society checked and are members of both the British Academy of Experts and the Expert Witness Institute. We write regularly for legal journals.

Clinical negligence cases normally require an assessment of lost earnings and altered career prospects due to, for example:

  • Injury at birth
  • Misdiagnosis of an illness
  • Non-treatment of physical or psychiatric conditions We have assisted on some high profile cases, some of which have won record damages.

Meeting clients’ needs

Isolating the impact of injury on claimant’s employment prospects: we identify the specific effect of an injury or injuries arising from alleged clinical negligence on the claimant’s employment prospects. For adult claimants this may require an analysis of their education, training, career and earnings prior to the injury, and a comparison of their earnings with published data on income levels in their field.

Consider the claimant’s health history: it is important to consider any pre-existing health problem or disability that might have affected the claimant’s employment prospects regardless of the injury in question. Children’s cases: in these cases, such as injury at birth, we normally provide a life-long career forecast. Range of scenarios: we take into account differences in expert medical opinion by presenting alternative scenarios for future employment. This is particularly useful if the final level of recovery is uncertain.

Information normally required from instructing solicitor:

For a child

  • Statement of Claim (if available).
  • Medical reports.
  • Statement(s) from parents that include details of their education, career histories and earnings.
  • Information about the employment histories of the wider family, in particular brothers and sisters (but also grandparents, aunts and uncles to identify if there are any family trends).
  • School reports prior to and following the injury (if appropriate). - KCA questionnaire for injured children and their families.

For an Adult

  • Statement of Claim (if available).
  • Medical reports. - Statement from claimant.
  • Other statements relevant to claimant’s employment prospects, if available.
  • Details of claimant’s gross earnings in the 13 weeks prior to the injury (if appropriate).
  • Academic report on claimant’s performance pre and post-injury if in higher or further education.
  • KCA questionnaire on employment completed by claimant.
