BACKGROUND
Over the last 20 years Keith Carter & Associates have developed a unique approach to assessing economic loss in personal injury cases. We have worked for the plaintiff, the defendant and, since the introduction of the Civil Procedure Rules in the United Kingdom, as joint experts and as the Court appointed expert.
We are recognised by the General Council of the Bar as external course providers for the New Practitioners Programme and are also accredited training providers by the Law Society and Institute of Legal Executives. We have prepared over 13,000 employment reports for more than 1,800 firms of solicitors from over 30 countries.
APPROACH
We provide an assessment of an individual’s pre-accident career options, career development and career earnings and compare these with opportunities that might be achieved post-accident to provide an estimate of losses. An evaluation of the individual’s residual earning capacity is an integral part of any assignment.
CASES
To date we have assisted South African lawyers in four types of cases. Notably where:
- A United Kingdom national has been injured while on holiday or working in South Africa but where their pre and post-accident career and earnings potential are in the United Kingdom.
- An individual has dual nationality and where their pre-accident career could have been in either South Africa or the United Kingdom.
- A professional has “international value” and could work in any country in the world. Careers analysed include those in mining, finance, engineering, entertainment, sports and leisure and have involved analysing labour markets not only in the United Kingdom and South Africa but also in Australia, America and Europe.
- The injured person’s pre and post-accident career opportunities lie in South Africa It is as a result of the increase in work in this last category that Keith Carter & Associates now have offices in South Africa, together with a growing library and database, specific to South Africa.
